Barkham Manor Farm Appeal against Enforcement Notice
to remove temporary building

We issued an alert in January 2020 which can be accessed by clicking here:

WBC refused the application and issued an enforcement notice (attached) and the applicant has now appealed to the Planning Inspectorate.  The appeal notice is also attached.

If you wish to make comments, or modify/withdraw your previous representation, you can do so on the Planning Portal at https://acp.planninginspectorate.gov.uk or by emailing TEAME1@planninginspectorate.gov.uk. If you do not have access to the internet, you can send three copies to:

Libby Hay, The Planning Inspectorate, Room, Temple Quay House, 2 The Square,
Bristol, BS1 6PN. Note that postal services are severely reduced at Temple Quay House due to the global pandemic.

All representations must be received by 18 November 2020.

For the convenience of residents, we have summarized the key details below, but more can be found in the attached Enforcement Notice.

The applicant was  seeking a Certificate of Lawful Existing Use and Development (“CLEUD”) for a structure that has been at Barkham Manor Farm since 2009, on the basis that it has been in existence without planning authority and remained unchallenged. There are two aspects this; the legality of the structure as constructed and how it has been used.

Barkham Manor Farm’s application 200041 sought to turn the temporary dwelling permanent, even though the permanent house is now being lived in, and allow it to be used as a non-agricultural residence.

The consolidation of two residences, with permission for one not to be confined to agricultural worker usage, would mean more traffic past the Manor, make it more difficult to resist other businesses being run from the premises and potentially more residential development in the future.

WBC refused to issue a CLEUD and issued an Enforcement Notice to the applicant to remove the temporary dwelling.  This is now being appealed.

Kind Regards
